By a 5-0 vote at its meeting on December
19, 2002, the Public Utilities Commission decided not to reconsider
its February 7, 2001 order regarding the socioeconomic effects of
Manitoba Hydro's hydroelectric generation upon the Pimicikamak Cree
Nation (PCN) and its members. In that earlier order, the Commission
found that, under the unique facts of this case, all socioeconomic
effects of that generation have been adequately internalized by
Manitoba Hydro pursuant to the December 16, 1977 Northern Flood
Agreement (NFA or "the treaty") and determined that a separate
Minnesota proceeding aimed at further accounting for those costs was
unnecessary.
The Commission specifically denied PCN's request for a contested
case hearing to further pursue the socioeconomic issues. However,
the Commission directed Xcel, the purchaser of the hydroelectric
generation in question, to monitor and report on the status of the
on-going implementation of the NFA in its next Resource Plan. The
Commission went on to approve the power purchase agreement with
reporting requirements and clarifications. A formal order in this
case will be issued within the next several weeks.
